A BILL TO BE ENTITLED

AN ACT

1 To amend Article 15 of Chapter 1 or Title 10 of the Official

2 Code of Georgia Annotated relating to deceptive or unfair

3 trade practices, so as to provide that no person may hold

4 himself or herself out as being a "certified safety

5 professional" or a "certified industrial hygienist" or other

6 similar titles unless he or she holds a certificate from one

7 of two certain organizations to define certain term.; to

8 provide for a penalty: to repeal conflicting laws; and for

9 other purposes.

10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

11 SECTION 1

12 Article 15 of chapter 1 of Title 10 of the official Code of

13 Georgia Annotated, relating to deceptive or unfair trade

14 practices, is amended by inserting at the end thereof the

15 following:

17 10-1-439. 41

18 (a) As used in this part, the term:

19 (1) 'American Board of Industrial Hygienists' means that 

20 nonprofit corporation organized under the Laws of the 

21 State or Pennsylvania to improve the practice and 

22 educational standards of the profession of industrial

23 hygiene and to certify individuals who meet its  

24 education, experience. and examination requirements.

25 (2) 'Board of Certified Safety professionals' means that

26 nonprofit organization organized under the laws of the 

27 State of Illinois to prescribe educational, experience,

28 and examination criteria for safety practitioners

29 involved in the protection of life, property, and the 

30 environment; to certify that individuals have met those

31 criteria.

1 (b) No person shall represent himself or herself us a

2 'certified safety professional,' 'associate safety

3 professional,' 'certified occupational health and safety

4 technologist,' 'certified industrial hygienist,' or

5 'industrial hygienist in training' unless he or she holds 

6 a current valid certificate from either the American Board

7 of Industrial Hygienists or the Board of Certified Safety 

8 Professionals.

9 (c) Any violation of this Code section shall constitute an

10 unfair or deceptive trade practice within the meaning of

11 Part 1 of this article, the 'Uniform Deceptive Trade

13 Practices Act'."

13 SECTION 2

14 All laws and parts of laws in conflict with this Act are

15 repealed.
